Information Text on Personal Data

As Etulle Curtain Systems (“Etulle”); we have prepared this information text to inform our visitors, online visitors, customers, potential customers, supplier employees, and supplier authorities about the processing, storage, and transfer of your personal data within the scope of activities arising from the Law on Protection of Personal Data No. 6698 (“KVKK”), the European Union General Data Protection Regulation (“GDPR”), and related legislation and legal regulations.

1) What Categories of Personal Data Do We Process and For What Purposes?

Your personal information may be processed by Etulle Curtain Systems in accordance with the principles stipulated in Article 4.2 of the KVKK: being in compliance with the law and good faith, being accurate and, when necessary, up-to-date, being processed for specific, explicit, and legitimate purposes, being relevant, limited, and proportionate to the purposes for which they are processed, and being stored for the period stipulated in the relevant legislation or for the period necessary for the purpose for which they are processed, within the scope of our established and ongoing business relationships with our business partners (it is possible for a person to fall into more than one category) for the purposes stated below.

A. Our Visitors

The identification information of our visitors (e.g., name, surname, TR ID number, place and date of birth) will be processed for the purpose of creating and tracking visitor records.

B. Our Online Visitors

The transaction security information of our online visitors who use our website (e.g., IP address information), marketing information (e.g., shopping history information, cookie records), and (if you provide them to us) identification information, contact information (your email address, full address, phone number) will be processed for the purposes of carrying out activities in compliance with legislation, conducting information security processes, tracking requests/complaints, carrying out communication activities, providing information to authorized persons, institutions, and organizations, and enabling your access to our website via the internet.

C. Our Customers

The identification information, contact information, customer transaction information (e.g., order information), financial information (e.g., balance sheet information), legal transaction information, marketing information (e.g., shopping history information) of our individual customers or the authorized persons and/or employees of our corporate customers; will be processed for the purposes of carrying out activities in compliance with legislation, conducting financial and accounting affairs, conducting/supervising business activities, conducting logistics activities, providing after-sales support services for goods/services, carrying out sales processes for goods/services, conducting marketing analysis studies, carrying out contract processes, providing information to authorized persons, institutions, and organizations, resolving legal disputes, carrying out storage and archiving activities, carrying out risk management processes, carrying out advertising/campaign/promotion processes, sending commercial electronic messages, carrying out loyalty processes for companies/products/services, and carrying out communication activities.

D. Our Potential Customers

The identification information, contact information, customer transaction information, marketing information of our individual customers or the authorized persons and/or employees of our corporate customers; will be processed for the purposes of managing goods/services sales processes, carrying out contract processes, carrying out advertising/campaign/promotion processes, sending commercial electronic messages, and carrying out marketing analysis studies.


E. Our Solution Partners

The identification information, contact information, dealer transaction information (order information, etc.), financial information (balance sheet information, etc.), legal transaction information, marketing information (shopping history information) of our individual solution partners or the authorized persons and/or employees of our corporate solution partners; will be processed for the purposes of carrying out activities in compliance with legislation, conducting financial and accounting affairs, conducting/supervising business activities, conducting logistics activities, providing after-sales support services for goods/services, carrying out sales processes for goods/services, conducting marketing analysis studies, carrying out contract processes, providing information to authorized persons, institutions, and organizations, resolving legal disputes, carrying out storage and archiving activities, carrying out risk management processes, carrying out advertising/campaign/promotion processes, sending commercial electronic messages, carrying out service processes for the end consumer, and carrying out communication activities.

F. Our Supplier Employees

The identification information, contact information, professional experience information (e.g., in-service training information) of our supplier employees will be processed for the purposes of carrying out communication activities, conducting/supervising business activities, carrying out supply chain management processes, carrying out logistics activities, carrying out activities in compliance with legislation, and carrying out occupational health/safety activities.

G. Our Supplier Authorities

The identification information, contact information, customer transaction information, financial information, marketing information, legal transaction information of our individual suppliers or the authorized persons of our corporate suppliers will be processed for the purposes of conducting/supervising business activities, carrying out goods/services procurement processes, conducting financial and accounting affairs, carrying out contract processes, carrying out investment processes, and tracking and carrying out legal affairs.

2) What are the Methods of Collecting Your Personal Data?

Your personal data, categorized above, is collected through automatic or non-automatic means via physical methods such as order forms, contracts, visitor forms, or through information systems and electronic devices (e.g., telecommunication infrastructure, computers, and telephones), third parties, our website, and other documents declared by the data subject.

3) How Long Do We Retain Your Personal Data?

Your personal data, categorized above, is stored for the period stipulated in the relevant legislation, if a period is stipulated; if no period is stipulated, it is stored for as long as our legitimate interest continues, taking into account the following criteria:
1.    Etulle practices
2.    Applied commercial customs
3.    Statutory limitation periods stipulated in the relevant legislation
At the end of these periods, the stored personal data is deleted, destroyed, or anonymized.

4) What is the Legal Basis for Collecting Your Personal Data?

Your personal data is processed by Etulle Curtain Systems for the purposes described above, based on the legal grounds specified in Article 5 of the KVKK, which are:
1.     Explicitly stipulated in laws,
2.     Being necessary for the processing of personal data of the parties to a contract, provided that it is directly related to the establishment or performance of a contract,
3.     Being mandatory for the data controller to fulfill its legal obligation, being mandatory for the establishment, exercise or protection of a right, being mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
4.    The identification and contact data of our Solution Partners, Customers, and Potential Customers will be processed for the purposes of advertising, campaigns, promotions, and sending commercial electronic messages, based on their explicit consent. You always have the right to request the cessation of communication regarding our advertising, campaign, and promotion activities and sending commercial electronic messages, and to withdraw your explicit consent.
If you do not wish to be contacted for advertising, campaign, and promotion activities and sending commercial electronic messages in the future, you can exercise your right to cancel via the contact information you have shared with us.

5) Do We Transfer Your Personal Data to a Third Party?

1.    The personal data of our visitors may be shared with law enforcement agencies and judicial authorities for the purpose of resolving legal disputes and when requested in accordance with relevant legislation.
2.    The personal data of our online visitors may be shared with judicial authorities and authorized public institutions and organizations for the purpose of resolving legal disputes and when requested in accordance with relevant legislation.
3.    The personal data of our customers is transferred to authorized public institutions and organizations for the purpose of tracking and conducting legal affairs, conducting activities in compliance with legislation, and providing information to authorized persons, institutions, and organizations within the scope foreseen by legal regulations; and to our group companies, solution partners, cargo companies, suppliers, banks, and financial advisor to the extent necessary for conducting/supervising business activities, carrying out risk management processes, and properly performing our services. In addition, the said personal data may be transferred to the law firm we receive services from and to judicial authorities to be used as evidence in future legal disputes.
4.    The personal data of our potential customers may be transferred to our solution partners to the extent necessary for the proper performance of our services, and to the law firm we receive services from and to judicial authorities to be used as evidence in future legal disputes.
5.    The personal data of our solution partners is transferred to authorized public institutions and organizations for the purpose of conducting activities in compliance with legislation, and providing information to authorized persons, institutions, and organizations within the scope foreseen by legal regulations; and to our solution partners, cargo companies, suppliers, and banks to the extent necessary for conducting/supervising business activities, carrying out risk management processes, tracking and conducting legal affairs, and properly performing our services. In addition, the said personal data may be transferred to the law firm we receive services from and to judicial authorities to be used as evidence in future legal disputes.
6.    The personal data of our supplier employees is transferred to authorized public institutions and organizations for the purpose of conducting activities in compliance with legislation, providing information to authorized persons, institutions, and organizations, tracking and conducting legal affairs, and conducting/supervising business activities within the scope foreseen by legal regulations; and to group companies, cargo companies, suppliers, our financial advisory office, and banks to the extent necessary for the proper performance of the service. In addition, the said personal data may be transferred to the law firm we receive services from and to judicial authorities to be used as evidence in future legal disputes.
7.    The personal data of our supplier authorities is transferred to authorized public institutions and organizations for the purpose of conducting activities in compliance with legislation, tracking and conducting legal affairs, providing information to authorized persons, institutions, and organizations, and conducting/supervising business activities within the scope foreseen by legal regulations; and to group companies, suppliers, cargo companies, banks, and our financial advisor to the extent necessary for the proper performance of the service. In addition, the said personal data may be transferred to the law firm we receive services from and to judicial authorities to be used as evidence in future legal disputes.

6) Do We Transfer Your Personal Data Abroad?

Based on the rules within the framework of Article 9 of the KVKK, it may be shared with third parties, our business partners/suppliers abroad.

7) How Can You Exercise Your Rights Regarding Your Personal Data?

Right to Rectification: If you have any personal data that you believe is inaccurate, you have the right to request its rectification from our company. At the same time, if you have any personal data that you believe is incomplete, you also have the right to request its completion from our company.
Right to Access: You have the right to request a copy of your personal data from our company. A certain amount of payment may be requested from you for this activity.
Withdrawal of Consent: You have the right to withdraw your explicit consent at any time without affecting the lawfulness of processing carried out based on consent before the withdrawal of your explicit consent given to our company.
Right to Erasure ("Right to be Forgotten"): In certain circumstances, you have the right to request the erasure of your personal data from our company.
Right to Data Portability: In certain circumstances, you have the right to request from our company that your personal data obtained by us be transferred to another organization or directly to you.
Right to Restriction of Processing: In certain circumstances, you have the right to request from our company the restriction of the processing of your personal data.
Right to Object to Processing: In certain circumstances, you have the right to object to the processing of your personal data by our company.
Right to Lodge a Complaint with a Supervisory Authority: If you believe that we are processing your personal data contrary to applicable data protection guidelines, you have the right to lodge a complaint with the competent regulatory authority, primarily the relevant supervisory regulatory authority in the Member State of your habitual residence or place of work, or where you consider the data protection infringement to have occurred, if you live in the European Union.
You can submit your requests related to the rights mentioned above and your requests within the scope of Article 11 of the KVKK, which regulates the rights of data subjects, through the “Data Subject Application Form” prepared to facilitate your process, in accordance with the “Communiqué on the Procedures and Principles of Application to the Data Controller” located at “http://www.etulle.com.tr” belonging to Etulle Curtain Systems.
