Declaration and Consent Confirmation Text Regarding Personal Data

 

Clarification Text on Personal Data

As Etulle Curtain Systems ("Etulle"); we have prepared this clarification text to inform our customers, online visitors, potential customers, supplier employees, and supplier authorities about the processing, storage, and recording of personal data within the scope of the services provided in accordance with Law No. 6698 on the Protection of Personal Data ("KVKK"), the European Union General Data Protection Regulation ("GDPR"), and relevant legislation and legal regulations.

1) What Categories of Personal Data Do We Process and For What Purposes?

Your personal data will be processed by Etulle Curtain Systems in accordance with Article 4.2 of the KVKK, which states that personal data must be; processed lawfully and fairly, accurate and up-to-date, processed for specified, explicit, and legitimate purposes, relevant, limited, and proportionate to the purposes for which they are processed, and stored for the period stipulated in the relevant legislation or for the purpose for which they are processed. In accordance with these standards, within the scope of our established and ongoing business relationships with our business partners (it is possible for a person to fall into many categories willingly), data may be processed in the financial year specified below.

A. Our Visitors

The identity information of our visitors (e.g., name, surname, Turkish ID number, place and date of birth) will be processed for the purpose of keeping and operating visitor records.

B. Our Online Visitors

Transaction security information (e.g., your IP information), marketing information (e.g., shopping history information, cookies), and (if you provide them to us) identity information, contact information (your email address, full address, phone number) of our online visitors who use our website; will be processed for the purposes of conducting activities in compliance with legislation, ensuring financial compliance, ensuring information security, following up on requests/complaints, distributing communication, transferring information to authorized persons, institutions, and organizations, and enabling your access to our website via the internet.

C. Customers

Identity information, contact information, customer transaction information (e.g., order information), financial information (e.g., policy information), legal transaction information, marketing information (e.g., shopping history information) of natural persons or members and/or employees of legal entities; will be processed for the purposes of budgeting activities in accordance with legislation, improving financial and accounting processes, conducting/auditing business processes, ensuring logistics flows, providing after-sales support for goods/services, maintaining goods/services sales, analyzing marketing data, increasing contract efficiency, providing information to authorized persons, institutions, and companies, resolving legal issues, improving storage and archiving, improving risk management departments, improving advertising/campaign/promotion departments, sending commercial electronic communications, improving the company/product/services, and improving communication components.

D. Our Potential Customers

Identity information, contact information, customer transaction information, marketing information of natural persons or members and/or employees of legal entities; will be processed for the purposes of expanding goods/services sales, expanding advertising/campaign/promotion activities, sending commercial electronic communications, and regional marketing analysis.


E. Our Solution Partners

Identity information, contact information, dealer transaction information (order information, etc.), financial information (balance sheet information, etc.), legal transaction information, marketing information (shopping history information) of our natural person solution partners or members and/or employees of our legal entity solution partners; will be processed for the purposes of distributing systems in accordance with legislation, improving financial and accounting processes, conducting/auditing business processes, ensuring logistics flows, providing after-sales storage support for goods/services, maintaining goods/services sales, analyzing marketing data, increasing contract efficiency, providing information to authorized persons, institutions, and companies, resolving legal issues, improving storage and archiving, improving risk management departments, improving advertising/campaign/promotion departments, sending commercial electronic communications, expanding services with the latest technology, and improving communication solutions.

F. Our Supplier Employees

Identity information, contact information, professional experience information (e.g., in-service training information) of our supplier employees; will be processed for the purposes of improving communication, conducting/auditing business processes, expanding the supply system, spreading logistical distribution, protecting activities in accordance with legislation, and improving occupational health/safety departments.

G. Our Supplier Authorities

Identity information, contact information, customer transaction information, financial information, marketing information, legal transaction information of our natural person suppliers or legal entity suppliers; will be processed for the purposes of conducting/auditing business processes, expanding goods/services purchasing sales, improving financial and accounting processes, expanding contracts, expanding investments, following up on legal matters, and archiving relevant documents.

2) What are the Methods of Collecting Your Personal Data?

Our personal data, as listed, is collected automatically or non-automatically through physical documents such as order forms, contracts, visitor forms, or information systems and electronic devices (e.g., telecommunication services, computers, and phones), third parties, our website, and other documents declared by the relevant person.

3) How Long Do We Store Your Personal Data?

Your personal data, as listed, is stored until a definite period specified in the relevant legislation changes; if no period is foreseen, it is stored by monitoring as long as our legitimate interest continues, taking into account:
1.     Etulle's practices
2.     Applicable commercial practices
3.     Statute of limitations rules in relevant legislation
Personal data stored for these periods are deleted, destroyed, or anonymized.

4) What is the Legal Basis for Collecting Your Personal Data?

Your personal data is processed by Etulle Curtain Systems based on the legal grounds stated in Article 5 of the KVKK for the purposes mentioned above:
1.      Explicitly stipulated in laws,
2.      Directly related to the establishment or performance of a contract; necessity of processing the personal data of the parties to the contract,
3.      Necessity for the data controller to fulfill its legal obligation, necessity of data processing for the establishment, exercise or protection of a right, and necessity of data processing for the legitimate interests of the data subject, provided that it does not harm the fundamental rights and freedoms of the data subject.
4.     The identity and contact data of our Solution Partners and Potential Customers will be processed based on their explicit consent for advertising, campaigns, promotional activities, and sending commercial electronic communications. You always have the right to withdraw your explicit consent to stop our advertising, campaign, promotional activities, and commercial electronic communication sending activities.
You can exercise your right to opt-out of receiving advertising, campaign, promotional activities, and commercial electronic communications by using the communication channels you shared.

5) Do We Transfer Your Personal Data to a Third Party?

1.     Personal data of our visitors may be shared with law enforcement agencies and judicial authorities for the purpose of resolving legal disputes and in accordance with relevant legislative requests.
2.     Personal data of our online visitors may be shared with judicial authorities and authorized public institutions and organizations for the purpose of resolving legal disputes and when requested in accordance with relevant legislation.
3.     Personal data of customers are transferred to authorized public institutions and organizations for the purpose of following legal affairs and improving them, providing information in accordance with legislation, and to authorized persons, institutions, and organizations; and to group companies, solution partners, cargo companies, internet service providers, payment service providers, and our financial advisor to the extent necessary to fulfill duties such as conducting/auditing business processes, improving risk management, and service suitability. Furthermore, said personal data may be transferred to legal offices and judicial authorities for use as evidence in future legal disputes.
4.     Personal data of potential customers may be transferred to our solution partners to the extent necessary to fulfill the requirements of services, and to legal offices and judicial authorities for use as evidence in future legal disputes.
5.     Personal data of our solution partners are transferred to authorized public institutions and organizations for the purposes of improving system usage in accordance with legislation, providing information to authorized persons, institutions, and organizations; and to our solution partners, cargo companies, internet service providers, payment service providers, and alternatives to the extent necessary to fulfill duties such as conducting/auditing business processes, improving risk management, following and improving legal affairs, and service requirements. Furthermore, said personal data may be transferred to legal offices and judicial authorities for use as evidence in future legal disputes.
6.     Personal data of supplier employees are transferred to authorized public institutions and organizations for the purposes of improving system usage in accordance with legal regulations, providing information to authorized persons, institutions, and organizations, following legal affairs, and conducting/auditing our operations; and to the group, cargo companies, internet service providers, our financial advisory office, and students to the extent necessary to fulfill service requirements. Furthermore, said personal data may be transferred to legal offices and judicial authorities for use as evidence in future legal disputes.
7.    Personal data of the supplier's authorized person are transferred to authorized public institutions and organizations for the purposes of improving system usage in accordance with legal regulations, following and improving legal affairs, providing information to authorized persons, institutions, and organizations, and conducting/auditing business processes; and to the group, integrators, cargo forwarders, alternatives, and our financial advisor to the extent necessary to fulfill service requirements. Furthermore, said personal data may be transferred to legal offices and judicial authorities for use as evidence in future legal disputes.

6) Do We Transfer Your Personal Data Abroad?

Your personal data may be shared with third parties, our business partners/suppliers in accordance with the rules outlined in Article 9 of the KVKK.

7) How Can You Exercise Your Rights Regarding Personal Data?

Right to Rectification: If any personal data is incorrect, you have the right to request our company to correct it. Similarly, if any of your personal data is incomplete, you also have the right to request our company to complete it.
Right of Access: You have the right to request access to your personal data. A fee may be charged for this activity based on the size of the request.
Right to Withdraw Consent: You have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal by the company.
Right to Erasure (Right to be Forgotten): You have the right to request the erasure of your personal data from our regular management program.
Right to Data Portability: You have the right to request the transfer of your personal data obtained from our management system to another organization or directly to you.
Right to Restriction of Processing: You have the right to request the restriction of the processing of your personal data from our expanded processing.
Right to Object to Processing: You have the right to object to the processing of your personal data by our company.
Right to Lodge a Complaint with a Supervisory Authority: If you believe that our processing of personal data is contrary to data protection instructions, you have the right to lodge a complaint with the competent supervisory authority, which is primarily the relevant supervisory authority in the Member State of your habitual residence or place of work if you live in the European Union, or where the data protection measures are implemented.
You can submit your requests regarding these rights and those covered by Article 11 of the KVKK (Personal Data Protection Law) concerning the rights of data subjects, by using the "Data Controller Application Form" found in the "Communiqué on the Procedures and Principles for Application to the Data Controller" on Etulle Perde Sistemleri's website at "http://www.etulle.com.tr" for your convenience.
